Contract Lead
Salary range: $80,000 to $85,000 per annum
Key Responsibilities
Strategic Tasks:
- Own and manage contractual disputes and customer escalations. Lead the resolution of contractual disputes and implement corrective actions
- Coaching and mentoring Contract Specialists
- Assist in improving existing contract policies to ensure compliance and reduce any potential risks
- Lead the full range of contract management support activities for the assigned portfolio
- Support the SRM Category Managers in external and internal cross-functional meetings/projects and provide advice on contract management related topics
- Co-lead with the SRM Category Managers on the development and implementation of continuous improvement initiatives for the SRM department ranging from streamlining internal processes to initiating and/or supporting cross-functional initiatives with other business departments
- Regularly monitor supplier performance against established key performance indicators/service level agreements and supplier’s contractual obligations. Work with an external legal counsel on supplier underperformance issues and/or breach of contractual obligations under the assigned portfolio. Develop and implement performance improvement plans/actions
- Support Strategic Sourcing team and the SRM Category Managers on contract negotiations with suppliers resulting from the sourcing initiatives, and review supplier suggested changes to standard agreement clauses and provide recommendations on the redlined agreement
- As applicable, assist Customers and Suppliers in the development of Customer-Supplier Agreements (“CSAs”) and thoroughly review CSAs to ensure proper execution and highlight any conflicts and risks against Master Agreement terms and conditions
- Co-lead with the SRM Category Managers for the Supplier Recognition Program. Identify continuous improvement opportunities of the Program and conduct an annual review of the Program. Build on the Program based on the collected feedback from Customers, Suppliers, internal, and other business departments
- Provide input towards improvement of RFX/Master Agreement processes and structure
- Act as a trusted advisor and subject matter expert for contract management activities in the assigned portfolio
- Proactively identify potential legal risks that may affect the assigned portfolio. Review existing contracts to locate any potential breaches and make recommendation on mitigation plan
Operational Tasks:
- Issue and manage Amendments (I.e., briefing note package) for assigned agreements/Suppliers:
o Price/Product Refresh
o Language Amendments
o Extensions
o Other applicable amendments as deemed necessary
- Ensure that the SMCR team is kept informed on all aspects of agreements contract renewals, and any changes due to amendments to the agreement
- Create communication on the centralized system and work collaboratively with cross-functional departments to send out communication to customers on contractual updates and promotional updates
- Respond to contract related inquiries for assigned agreements
- Manage supplier performance i.e., through review of KPIs/SLAs and other obligations within the contract
- Lead Business Reviews with Suppliers in assigned categories, conduct, and discuss contract management aspects, such as performance reviews and contract-related activities
- Review, validate and ensure that CSAs for assigned portfolio are up to date
- Other projects and activities, as assigned
- Co-lead the Supplier Partner Orientation Meetings for suppliers in assigned category agreements
- Review all documents pertaining to newly executed Master agreements (CSA template, pricelist, second stage guide and template)
- Manage the contract transition and close out plans as required by working with suppliers and the CRM team
Skills and Qualifications
- Ability to work well under pressure and produce high quality work in a fast-paced, changing environment
- Strong knowledge of public procurement principles and contract law
- Post-secondary degree/certificate in one of the followings: social science, pre-law, business, supply chain management, or other related areas
- Demonstrated experience in contract negotiations and management (amendment, extension, close-out, renewal)
- Detail-oriented, flexible, self-starter with high desire to learn and refine approaches to increase personal and organizational impact
- Proactive with a sense of urgency
- Team player with strong ability to work independently with minimal supervision
- Passion for service excellence
- Results-driven, responsible, with strong commitment to contributing to the success of OECM’s business objectives
