Commercial And Contracts Manager - Broadway Subway Project

TI Corp is Crown Corporation that has a mandate to deliver $13.3 Billion in major infrastructure on behalf of the BC Ministry of Transportation and Infrastructure and the Ministry of Tourism, Arts, Culture and Sport.

Job Overview

This position is responsible for supporting the development, management, and execution of the project commercial management workplans and administering the Project Agreement (PA) between the Owner and Project Contractor.

Key Accountabilities

• Attends key design/construction meetings, both internal and external, as required.
• Assists in drafting of contractual correspondence; and liaises with legal when appropriate.
• Provides subject matter expertise related to commercial implications within the PA Agreement to the team when/if required.
• Supports and participates in training requirements for the Commercial and Contracts team.
• Working closely with the Owner’s technical and construction management teams, leads the day-to-day administration of commercial terms within the contract between the Owner and Design Build Finance (DBF) Contractor.
• Participates in the coordination of commercial lessons learned from projects for PA continuous improvement.
• Undertakes assigned commercial tasks under guidance of the Commercial & Contracts Director.
• Attends and contributes as appropriate to the Commercial Community of Practice.
• Supports in the management of contractual and ex-contractual claims.
• Drafts contractual correspondence, as directed by the Commercial & Contracts Director.
• Prepares and maintains commercial trackers (disputes, claims, changes, payments) and maintains commercial sections of project SharePoint site.
• Prepares analysis of contractual claims, change valuations, as directed by the Commercial & Contracts Director.
• Supports the management of disputes up to, including and after Expert Panel / Referee stage, including mediation, litigation & arbitration.
• Reviews, evaluates, and approves as appropriate the management of PA payment applications, change management, and Performance Incentive Management processes.

Qualifications

• Experience developing and implementing strategies for risk and opportunity management.
• Thorough understanding of construction estimating, contractual, commercial, and financial functions on major projects.
• Claims management/dispute resolution experience on major projects.
• Experienced negotiator of contracts, claims, and changes.
• Strong knowledge of contract language, change management, and legal requirements of contracts.
• Bachelor’s degree in quantity surveying, , civil engineering or construction management, or equivalent relevant experience.
• Experience with Provincial DB/DBF contracts within the Transportation sector would be considered an asset.
• 10+ years of progressive experience in the design, construction and contract administration of major infrastructure projects (preferably design-build transportation projects).
• Ability to liaise/co-ordinate internal and external legal counsel and experts.
• Strong relationship, communication, facilitation, negotiation, presentation, and interpersonal skills.
