Course Description: Le pluralisme juridique correspond à la coexistence d’une pluralité d’ordres juridiques au sein d’un territoire ou d’une population donnée ainsi qu’aux manières de penser le droit qui découlent de cette coexistence. Le pluralisme juridique ainsi compris se manifeste autant dans l’hétérarchie des autorités en droit international que dans l’accommodement d’espaces de liberté pour les droits dits « traditionnels », ou encore, dans l’ouverture de la science juridique à la pluralité de la pensée « postmoderne ». Dans ce cours, nous allons étudier les théories qui permettent de comprendre ces phénomènes. Nous allons entre autres étudier ce à quoi le pluralisme juridique s’oppose (le centralisme politique et juridique), les différents types de pluralisme juridique (classique, contemporain, socio-scientifique, critique, etc.), les grands enjeux que soulève la coexistence des ordres juridiques (polyjuralité, internormativité, globalité, etc.) et les implications pratiques du pluralisme juridique (pour les théories de l’interprétation, les modèles de gouvernance, etc.). Nous allons également nous pencher sur la nature particulière du pluralisme juridique mcgillois – aussi connus sous le nom de « transsystémisme » – comme théorie et pédagogie juridique
